Terms of Use

These Terms of Use ("Terms") govern your access to and use of lod.gy and any subdomain or custom domain we host on your behalf (the "Service"), operated by Lodgy Technologies, LLC, doing business as Lodgy ("Lodgy," "we," "us," or "our"), a limited liability company organized under the laws of the State of Georgia, USA. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Lodgy lets a host ("Host," "you") submit a listing URL from a third-party platform (currently Airbnb or Vrbo) and generates a branded, direct-booking microsite at a subdomain of lod.gy or a custom domain you connect. The Service may include pricing configuration, guest inquiry forms, Stripe-powered checkout for direct bookings, calendar synchronization, and analytics.

2. Accounts

You must provide accurate registration information and keep your credentials confidential. You are responsible for all activity under your account. Notify us immediately of any unauthorized access.

3. Host Responsibilities

  • You represent that you have the right to list the property and to use the source listing content (photos, descriptions) you import or that Lodgy imports on your behalf.
  • You are solely responsible for the accuracy of pricing, fees, availability, and property details displayed on your microsite, and for honoring any booking made through it.
  • You are responsible for complying with all laws applicable to your property, including short-term rental licensing, occupancy tax collection and remittance, and health/safety regulations. Lodgy does not collect or remit occupancy taxes on your behalf.
  • You must not use the Service to list a property you do not have the legal right to rent, or to misrepresent your identity, your property, or your affiliation with any third-party platform.

4. Payments

Direct bookings made through your microsite are processed by Stripe, a third-party payment processor. Lodgy does not store your guests' full payment card details. Funds for bookings flow through your own connected Stripe account (or Lodgy's Stripe integration, as applicable to your plan) subject to Stripe's own terms. Lodgy is not a party to, and assumes no liability for, the underlying rental transaction between you and your guest.

Subscription fees for using the Service, if applicable to your plan, are billed in advance on a recurring basis via Stripe. Fees are non-refundable except as required by law or as otherwise stated at signup.

5. Not a Party to the Rental

Lodgy is a technology platform, not a rental company, property manager, real estate broker, or insurer. Lodgy does not own, operate, inspect, or control any listed property, and is not a party to the rental agreement, reservation, or stay between a Host and a guest. Hosts are solely responsible for the condition, safety, legality, and habitability of their property, for guest communications, for honoring or canceling reservations, for issuing any refunds, and for carrying insurance appropriate to short-term rental use.

LODGY DISCLAIMS ALL LIABILITY FOR ANY INJURY, DEATH, PROPERTY DAMAGE, THEFT, DISPUTE, CANCELLATION, OR OTHER LOSS ARISING FROM OR RELATED TO A GUEST'S BOOKING, STAY AT, OR INTERACTION WITH A HOST'S PROPERTY, REGARDLESS OF WHETHER THE BOOKING WAS MADE THROUGH THE SERVICE.

Listing copy, amenity descriptions, and similar text may be generated or refined with the assistance of AI tools based on data supplied by the Host or sourced from a third-party listing. Hosts are responsible for reviewing and correcting AI-assisted copy before publishing; Lodgy does not guarantee its accuracy.

6. Third-Party Platforms

Lodgy is an independent service and is not affiliated with, endorsed by, or sponsored by Airbnb, Vrbo, or any other listing platform. Any trademarks referenced belong to their respective owners. You are responsible for complying with the terms of service of any platform from which you source listing content.

7. Acceptable Use

Use of the Service is also governed by our Acceptable Use Policy, which is incorporated into these Terms by reference.

8. Intellectual Property

Lodgy retains all rights in the Service's software, design, and branding. You retain ownership of your property content (photos, descriptions, custom copy) that you provide or that is imported on your behalf. You grant Lodgy a limited license to host, display, and process that content solely to operate the Service for your microsite. See our Copyright Policy for how we handle infringement claims.

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, the Acceptable Use Policy, or if required to comply with law. Upon termination, your microsite will be taken offline; certain records may be retained as described in our Privacy Policy.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT SCRAPED LISTING DATA, AI-ASSISTED COPY, OR PRICING CALCULATIONS WILL ALWAYS BE ACCURATE OR CURRENT. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LODGY TECHNOLOGIES, LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BOOKINGS, ARISING FROM YOUR USE OF THE SERVICE OR ANY PROPERTY LISTED ON IT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

EXCEPT FOR (A) YOUR INDEMNIFICATION OBLIGATIONS BELOW, (B) YOUR VIOLATION OF OUR INTELLECTUAL PROPERTY RIGHTS, OR (C) LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW (INCLUDING GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR FRAUD), OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (I) THE AMOUNT YOU PAID LODGY IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (II) ONE HUNDRED U.S. DOLLARS ($100).

12. Force Majeure

Lodgy will not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including acts of God, natural disaster, war, terrorism, labor disputes, internet or utility failures, or outages or policy changes by third-party providers we depend on (including Stripe, Cloudflare, our hosting providers, or source listing platforms such as Airbnb or Vrbo).

13. Indemnification

You agree to indemnify, defend, and hold harmless Lodgy and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from: your property listings; a guest's stay at or dispute with you regarding your property; your violation of these Terms; or your violation of any law or third-party right.

14. Dispute Resolution; Arbitration; Class Action Waiver

You and Lodgy agree to first attempt to resolve any dispute informally by contacting support@lod.gy. If a dispute is not resolved within 30 days, you and Lodgy agree that it will be resolved by binding individual arbitration administered under the rules of the American Arbitration Association, rather than in court, except that either party may bring an individual action in small claims court.

YOU AND LODGY EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. Claims must be brought in an individual capacity only. If this class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) may proceed in court, with the remainder of this section remaining in effect.

15. Governing Law

These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-law principles. Subject to Section 14 above, any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Georgia.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be indicated by updating the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
